MyOrganicTshirt.com (hereafter called « The website ») is edited by the following company, KOLAM, a Limited Liability Enterprise with a capital of 6 000 euro, and whose Head Quarters are in PARIS (75014) – 2, rue des Plantes, and is registered with the RCS of Paris under the number 493 464 390, TVA intercommunity number n° FR37 493464390 (hereafter called « the KOLAM Company»). All orders made on the website are subject to the present general conditions of sale. The KOLAM Company reserves the right to adapt or to modify, at any time, the present conditions, the version of the general conditions of sale, applicable to all transactions made on line on the www.MyOrganicTshirt.com website, during the order.
I The Customer The Customer declares to be a physical person, of at least 18 years of age and to possess the legal capacity or to have parental authorization that allows him to pass an order on the website. During the registration of the Customer’s personal information in the “my account” area, he/she must guarantee the exactness and the completeness of all mandatory information that is given. In the case of an error in the contact details of the recipient, the MyOrganicTshirt Company cannot be held responsible for the inability to ship the product. The KOLAM Company reserves the right to cancel any order if the Customer’s IP address is hosted in a different country from that of the billing and/or shipping address.
II The Products The products proposed for sale are those described on the Website. The KOLAM Company takes the utmost care in the presentation and the description of these products to best satisfy the information that is supplied to the Customer. It is nonetheless possible that unsubstantial errors could figure on the Website, which the Customer acknowledges and accepts. In any case, in the event of the non-conformity of a product shipped to the Customer with regards to its description on the Website, the Customer can either, exercise his right of retraction, or put the KOLAM Company’s conformity guarantee into application which will proceed, if needs be, either to an exchange or a refund of the price (in whole or in part) that may have been billed.
III The Order Placing an order on the Website is subject to respecting the procedures set in place by the KOLAM Company, which is put into practice by a succession of different steps that the customer must absolutely follow to be able to validate the order. The customer will have the possibility, before validating definitively the order, of verifying the details of the aforementioned order, its total price, and of correcting any possible errors, before proceeding to confirm the order and its express acceptance. All orders confirmed by the Customer are worth a sales contract as well as acceptance of all of the present terms and conditions. The KOLAM Company will refuse all orders placed by a customer with who there is litigation or if an incident exists relative to the payment of a previous order, or a customer who violates the dispositions of the present terms and conditions. In this event, the KOLAM Company will inform the Customer by email. If the customer does not ask the KOLAM Company for the readjustment of the mistaken products or is in breach of the present general conditions of sale, the KOLAM Company retains the right to not proceed with the order. A confirmation email summarizing the order (products, prices, availability of the products, quantity…) shall be addressed to the customer by the KOLAM Company. To this effect, the customer formally accepts KOLAM Company’s use of electronic mail as a means to confirm the contents of the order. In all cases, billing is made upon delivery.
IV Prices and Payment modalities
1. Price Determination The prices of the products are indicated in euro, all taxes included, without the participation in delivery and shipping costs. The KOLAM Company retains the right to modify all prices at any moment but the products shall be billed based on the prices in place when the order was placed, subject to availability.
2. Method of payment Payment is effective in whole the day the order is placed. Payment of purchases are made either by : - Bank check : In the event of payment by a bank check, this latter must be issued by a bank domiciled within metropolitan France. Cashing of the check is made upon its reception at the following address : KOLAM 3. The information recorded and kept by the KOLAM Company constitutes the proof of order as well as all of the transactions made. The information recorded by the payment system constitutes the proof of all financial transactions.
V – Delivery Delivery will be made to the shipping address as indicated by the customer, being clear that this must be the customer’s home address or of any other physical person that the customer chooses, resident in metropolitan France. In order for deadlines to be respected, the customer must guarantee that the information given is exact and complete, with regards to the shipping address (such as, in particular : street number, or building and staircase number, access codes, names and/or interphone numbers, etc.). Delivery periods indicated are rough time periods that correspond to the average time periods for treatment and shipment. In the event of damaged shipment (already open, missing products…), the Customer must notify the transporter and the KOLAM Company, by all means, under all conditions within the 3 days following reception of the product.
VI –Retraction Each Customer disposes of the right of retraction, that he/she may exercise without motives, within a time period of seven (7) full days from shipment of the order, which will be made clear by the return of all new products (in its original packaging, unworn, unwashed) at the Customer’s own cost. The demand for a return will be made by first accessing the customer area; no returns will be accepted without the acceptance of the demand for a return in question by the KOLAM Company. The KOLAM Company will refund any eventual sums that have already been paid, with the exception of any eventual cost of sending, as stated in article VII that follows.
VII – Refunds Refunds on products in the eventualities as evoked in articles II and VI will be made by the KOLAM Company within a maximum time period of 30 days following reception by the KOLAM Company of the aforementioned products. The refund will be made following the same method of payment chosen by the customer when he/she placed his/her order or through a purchase voucher.
VIII- Governing laws All orders shall take full rights of the customer and his/her acceptance of the general conditions of sale. These general conditions of sale are governed by French Laws. In the event of litigation, French Courts are held solely competent. In case of any difficulties or complaints when placing an order, the customer may address Customer Services to find an amicable solution.
IX – Information and Freedom All information collected by the KOLAM Company when placing an order are needed to manage the transaction and to this effect may be communicated in part or in whole to service providers of the KOLAM Company who intervene in the fulfillment of the order. The customer is informed that this same information of personal nature may also be gathered by an organism in charge of analyzing orders as well as organisms in charge of combating credit card fraud. In accordance with the law of Information, Internet Technologies and Freedom n°78-17 of the 6th January 1978, the customer disposes of a right of access, of rectification, of opposition and of suppression of all information that concerns him/her.
